Enduring Guardianship

Enduring guardianship is a legal tool that allows you to appoint someone to make health and lifestyle decisions for you when you can't do this for yourself. These forms can be downloaded and used if you are planning on appointing or revoking an enduring guardian, or resigning as an enduring guardian.

Capacity

The 'Capacity Toolkit', [PDF 1Mb] produced by the Department of Attorney General and Justice, provides information about capacity and how to decide if a person has the capacity to make their own decisions. Our website has further information on capacity and guardianship.

The Guardianship Division of NCAT determines applications for:
  • guardianship
  • financial management
  • consent to medical and dental treatment
  • approval of clinical trials
  • reviews of enduring powers of attorney
  • reviews of an enduring guardianship appointments
